It looks like some type of Laurel tree(bay leaf). It's definitely not a pepper. Maybe if you had pics of it flowering someone could identify it.

Rajun Gardener   Thank you for your input but I do own a Bay laurel plant. It has been growing in my backyard for about 3 years now. The leaves are much shorter and not nearly as glossy, long, and they are course.
 
Okay let's say that this is not a pepper plant. Does anyone have a clue what plant would produce a yellow fruit that is mild and sweet?

Odd how this all works.  I contacted a person in the hort department at LBCC.  He says it is a jasmine.  I grew this from seed so I know it is some kind of a pepper.  When I find out which one it is I will notify the group.
