Sales Tax on Ebay

I made a purchase last night in which the seller charged a sales tax. The item shipped from California destination New Mexico. I was under the impression that you had to have a business license in the destination state to do that.
 
Something I thought I would pass along. Keep an eye out for your eBay purchases if sellers are doing this. Cheers.
 
The business you purchased from may have brick and mortar in your state, whether that is a store, distribution center, etc.
 
I often save money on amazon by purchasing though a marketplace seller that does not charge tax even if it looks like the amazon price is lower, with tax it is not. ;)
 
If that was the case wouldn't the item have shipped from New Mexico. If he doesn't have a New Mexico business license and is charging tax, isn't that illegal?

No it does not mean it would have shipped from NM. I order things all the time, they may come from the west coast, and have tax, because they have some sort of biz in NY.
 
This is simple. Ask them why you were charged tax.
 
I did and he said they have a warehouse here.
 
I also wonder why thrift stores charge a sales tax, if an item was purchased the sales tax was already paid. if they donate the item and resell it at thrift, isn't that double taxation?
 
No that is not double taxation, the product is not taxed, the sale is. "Sales" tax. Buying wholesale for resale is different and businesses can hold a resale certificate to avoid double taxation. :)
 
I'm not sure what you want thehotpepper community to do. If you think you were charged tax illegally take appropriate action. But you have not named a company name, or provided any proof they should not collect so what is your point?
 
If you think you were overcharged, simply report it to eBay. From what you posted there is nothing really to look out for, tax is life.

Even if you order online from a seller that does not charge the sales tax you are supposed to pay the same amount in a use tax to the state with your State tax return when you file  - so he is just helping you not have to report it and pay it yourself at the end of the year ! ( You do keep track of all your purchases and report them when doing your taxes correct ?? )
 
Not sure how you could complain about them charging if you are following the law and paying the use tax on other purchases like you are supposed to !
 
Use-tax is for states doing business in the state you order from only. If you order from Oregon and live in NY and they do not do business there, no tax.

Nope - As an individual residing in the state you are responsible to pay the use tax for online purchases you make that do not collect a sales tax if you use the item purchased in the state. Even if you order a product from another country you are supposed to pay the use tax on the purchase price of the item if you live in the state and use the product in the state.

I see what it is now. States trying to collect post-sale. Read up on it a bit. Say consumers rarely pay.
 
I've much to learn here and appreciate it all. I don't charge sales tax on internet sales, but do claim it (or a portion thereof) because the intermediary (credit/debit card platform) reports it to the Fed gov as income. As a new company I'm learning the ropes. I guess I will eventually figure out if I'm legally compliant or voluntarily screwing myself. I will say that "I love cash."
