yep, that's a chilli plant, appears to be a chinense of sorts but i could be wrong. let's wait until it flowers and pods.

i planted trinidads, red bali chilli, and a few bhut jokia

but if i remember correctly those are the trinidads i could be wrong though
 
i should probably think of getting a larger pot, but how large ?
I usually wait until I see the roots start growing out the bottom holes before repotting, but I would definitely take care of the other little one now (either transplant it into a separate pot if ya plan on keeping it or snip it if not).

As for pot size, I prefer to pot up in increments (one pot size up at a time until I reach desired final size). And as for a final size, them 30cm/14L pots are usually a good size for most chinenses.
