Couple sue after Mega Death sauce hospitalizes son

I thought I was going to die! If I as at home I would have gone to the ER for sure (seriously).
Don't worry I know. Some people may think that is an exaggeration but it is not. And not from the heat folks, it's an after effect of the extract. Hits about 20 minutes later. Feels like acid eating away at your stomach lining and you're keeled over in hellish pain. For me, happened after too much extract (multiple extract sauce tasting).
 
If the kid did this without the knowledge or consent of the person who consumed said extract then yes......it is a valid case. But if it's similar to the McDonalds coffee case from the 90's then.......*sigh*

Yeah no fun at all, Hot Popper had it happen when he did that one sauce video, extracts can be really nasty.
 
THP is right, the restaurant might as well just get out the checkbook. :shocked: They're lawyer knows go for the deep pockets and sue the restaurant, suing the server you wouldn't get shit, but he's probably named in it too. For that amount of money, this one will be settled out of court.

ALSO THE SERVER REALLY SHOULD NOT HAVE DONE THIS, THE OPTION SHOULD HAVE BEEN OFFERED NOT JUST DONEand he should not have offered a sauce that hot, not everyone is a veteran chilehead and let alone a child that's not used to eating that stuff

Did you read the article? The lawsuit could have validity. A minor child was (allegedly) served and encouraged to use the sauce. You don't know all the details. Maybe it was a prank by some kids working there. Maybe the label was missing. These sauces are no joke especially when expecting Tabasco. If he did break out into hives, have trouble breathing, and suffer pain (anyone here had that extreme abdominal pain from extracts that makes you want to call the ambulance?) it could be a valid case.


And the parents could have excersized responsibility and checked the sauce first.
 
Not enough info to make an informed decision on this one.

I will agree that our country has wrapped their arms around making an easy dollar, or 50,000 of them, via litigation and the attitude of "someone must pay" for their troubles. Personal responsibility has become a thing of the past.

The parents must take some of the blame though. If I have any doubts or questions concerning something my kid is about to eat I don't let them eat it or I get the answers. With the symptoms noted it appears the kid had some type of allergic reaction to one or more of the ingredients in the sauce. If I know my kid has food allergies you can be damn well sure I know exactly what he's eating.
