Nah, it's a patent for a specific hybrid they created, including the fruit and seeds that it produces.
 
"The parental lines are DNAP 89300 (PVP 8800202, Vegi-Sweet), as the female parent and DNAP 94166 as the male parent."
 
Then they talk a little about the method they used to create said hybrid. But it's not the pollination they are patenting. What they tried to patent is the method of "crossing a first red-fruited pepper plant that is sweet, low-seeded and resembles a Jalapeño pepper in size and shape with a second orange, fruited pepper plant that is sweet, low-seeded and resembles a Jalapeño pepper in size and shape. F1 plants that are red-fruited, sweet, low-seeded and resemble a Jalapeño pepper in fruit size and shape are then selected."
 
So if I'm reading it correctly, you can't follow this specific method to create this specific hybrid. You could follow the exact method to create an orange-fruited, sweet, low-seeded, Jalapeño-resembling F1 plant, for example. Still ridiculous though.
 
Edit: Or, alternatively, you could use two parent plants that look exactly the same as their's, but are high-seeded, to create the exact same hybrid but with more than the 25-30 seeds they describe in the patent. Oh what's not to love about patent law in the USA. Glad Europe banned patents on naturally selected traits and stuff.
 
Now I am really confused.  I thought you could not patent a plant that reproduces sexually.  That is what PVPA is for.  I have got to be missing something.

Can't say PVP protected Frank Garcia and the Red Savina but there are those that abide by the rules, ChilePlants.com, even though the protection expired in 2011. And if you consider what it takes for paperwork and proof, How to Apply for PVP, let's not forget the quantity of seeds = 3000 and the application cost = $4382.

What is claimed is:


1. A hybrid pepper plant grown from seed deposited with the ATCC under Accession No. PTA-2275.
 
 
Theyve patented just one variety, specifically the variety deposited under accession number [SIZE=13.3333px]PTA-2275.[/SIZE]

No clue if PVP is worth it.  Kind of figure if one person was the only one who could legally sell Carolina Reaper seeds they would have made a mint back when it came out.  So maybe it is worth it for the big boys.  No clue.  What I do know about PVP is that you must demonstrate not only uniqueness but stability.  You have to prove it is a new strain.

To those web sits: No, Dragon's Breath did not take the throne officially.  Neither did Pepper X.  This is getting down right silly.  The article essentially cites Mr. Curry who appeared on the Youtube TV show that the thing references.  Its official because someone said it is?  What?
 
Someone should put together a dream team of growers working in collaboration: Aj, d3, cpmman, capcom, 96strat, blackfatali, Primo, etc and many more here to do the definitive super. This pepper is called murder, and you better have the paramedics en route if you attempt to eat it. It will only be used for poison darts.. to bring down mammoth.
 
Thanks for including me, but i am just now starting to have anything happy come out of my crossing efforts.  Primo is a college educated horticulturalist.  I dont know about crossing, but cpmman has been growing and collecting sine before it became popular.  On the other names, don't know much other than they have been here for much time.
