:welcome: from Minnesota. Just to let you know, brain strain is a registered trademark owned by a guy named Cappy who is a member here. He also has a hot sauce named brain strain. You might wanna look into that.

Thanks for the warm welcome!

You may be talking about a US TM, I am in Canada and we just about have a Canadian TM so it was cleared. ;)

Besides apparently there is no US TM: http://tess2.uspto.gov/bin/showfield?f=toc&state=4009%3A5ssmo6.1.1&p_search=searchss&p_L=50&BackReference=&p_plural=yes&p_s_PARA1=&p_tagrepl~%3A=PARA1%24LD&expr=PARA1+AND+PARA2&p_s_PARA2=brain+strain&p_tagrepl~%3A=PARA2%24COMB&p_op_ALL=AND&a_default=search&a_search=Submit+Query&a_search=Submit+Query

But thanks :)

Your link didn't work, and just copying someone else's idea/name probably won't work either. Who are you trying to fool?

Hello mm, our attorney did all the necessary TM searching and clearing, so no worries!

I hope you enjoy Brain Strain, I'll send you over a bottle!

Thanks, but no thanks. I don't care if you are legal or not. It's just not a cool thing to do, and I doubt if you'll get much respect around here.

No prob mm! Sorry didn't know offering hot sauce in the welcome section was disrespectful. Please see my Promotion post and and I apologize.

Offering hot sauce is great! Ripping off someone else's business name for your own profit is quite lame though.

I don't know, maybe this is the first you have heard about it, but you sure didn't seem surprised. ;)

Sorry, mate, I'm in agreement with musky. Legal or not, ripping someone else's name is way not cool. And a damn risky move when you're trying to build a rep...

Welcome to TheHotPepper! I am also from Toronto. :)

We the members have no problem with you trying to expose your hot sauce here - I personally wouldn't mind a sample of your delicious concoction - but someone else has already chosen the name Brain Strain. Consider that this is perhaps the biggest hot food community online, you might want to be a little careful about the brand names you choose.. some people here have a lot of influence that goes a very long way, and it could negatively impact your company's position as a chili product manufacturer. I mean the very best when I say this. Perhaps a minor product name change would do you well?

:welcome: from Chicago. I do agree with everyone else, a name change should be definite. Even if it was "cleared", it should be changed in respect of cappy.

Welcome from Ottawa
I agree with finding a new name. I don't know the legalities but its just not right and will lead to a lot of confusion and conflict. Does your sauce even have Brain strain chiles in it?
