I filled out the Statement of Use (last step in the formal Trademark Registration process) and paid my $100 today.

This completes the Trademark Process for AlabamaJacks Exotic Superhots[sup]®[/sup]

It has taken a long time it seems. If you ever apply for a trademark, be sure to keep on top of it and not miss the Notice Of Acceptance like I did...it cost another couple of hundred to get the application back on track.

But for now, I have my business name formally trademarked
 
Thats cool AJ, I always wondered how to procure a name,I have no business, but thought that a trademark "just in case" would be in order. So,,if you see someone using your trademark what are the repercussions? and do you have to reserve all the website names that closely resemble yours? as in do you have to pay for multiple domain names? I have been interested in this for awhile now. I have a sauce name that hasnt been used but,"just in case" I decide to jump in.I want the name!

thanks wayright...there are services (that yo uhave to pay for) that monitor a lot of different things for trademark infringement and will notify you if any is found...I don't think anyone would want to use it right now, but who knows what the future will hold...I suppose it all depends on "how big" I want to get...

anyone can trademark anything out there as long as it has not already been trademarked...But, when you apply for a multiword trademark like I did, you have to sign a waiver that you won't try and prohibit anyone from using each word by themself...my wife works in the legal department and a trademark/patent atty there showed me the patent someone had taken out on a "Peanut Butter and Jelly Sandwich"...that is no joke...if you have an idea of a trademark you may use in the future, you can certainly apply for it, but you have to file notice of "Intent to Use"...the flatrate for the trademark is $325 plus $100 when you file the SOU so a total of $425 per trademark...there are many many chapters applicable to most products under which to file a trademark..but get this, each chapter and section of that chapter cost $325 to file...and once you file for the trademark, there is NO refund...for instance, if you apply for a trademark without searching the database and someone else already has that trademark under the same chapter and section you file under...your 325 is history...I will quit rambling now...

Congrats AJ. It sounds like the same process over here in Aus.

Wayright- You have to choose which categories you want it to be trademarked in (it doesn't trademark the name for every use) and then we have to pay for each category as well. So if you want it for sauces and food products that is one category that you pay for but if you want it for that as well as plants or books then that is another one to pay for. Also if you want it internationally then you have to register it in every country that you want your name not to be used. So if you are someone big like Coca Cola imagine how much it cost them to register! It takes a long time and can get quite costly but after what I have been through lately it is definately worth doing at the start.

With websites I don't think it gives you the automatic right to use it. You could have Alabama Jack's Exotic Superhots for sauces and Alabama Jacks Exotic Superhots for Plants. They could both be trademarked but who has the right to that domain name? If you don't want someone to have a similar domain name to you or you want a different ending on it eg. .com and .com.au then you have to register and pay for each one seperately.

If someone uses your name illegally then you also have to sue them or take them to court to stop them from using it. That could be quite costly also. Unfortunately just because you have trademarked something it is not that easy in the end.

The website construction will begin after ZestFest when I meet with one of our members and discuss what I want...

I know you were joking but, if I decide to go that way...I would first have to have the right contacts/contracts...then I would have to incorporate, have a board of directors, have directors meetings and issue minutes of those meetings, issue stock, and so on...that gets way more complicated than I can comprehend...corporate law is very complicated...and the money...in a tight economy like it is now, who knows what will happen other than losing my donkey...

Congrats AJ - Man when you do something it aint half arsed ! Amazing you went from growing a few peppers to trademark and website ! next you should sell your plans on your seed incubater - Best of luck
