are these ants or termites?

found a huge mound of ants , and a few of them, i would say 1 out of 30, have wings. took a few pics. the ant mound was in burnt ash, wood chip, bush shreds mound from yard work. They are all carring what appears to be baby ants.
 
 
can you tell if these are flying ants, or termites?

that is a ant!   and all ants have ranks that can fly!  as far as i know?

only problem the ants will give you is aphids. so maybe just spray something for aphids?   we have fire ants here and you just got to get use to getting bit! cause you will never win the battle.

definately not termites. trust me I live in termite territory.
