Contract Busting

Saw a conversation about Contracting Busing seeds.  It was a how to kill Monsanto sort of thing and the principle would not work with the Monsanto contract I have seen because that contract specifically says no seed saving for any purpose.  But I wonder if the idea is not legit for the pepper seed companies that just forbid commercial use of the product of their seeds.  They called these seeds: Contract Busted.  Her is how the conversation described "Contract Busted Seeds"

Person A buys seed under contract.
Person A gifts seeds to person B.
Person B is not subject to the contract that person A was.

I -think- this might be a thing.  Not for patented or PVP plants, but for the seed companies that try to maintain a monopoly with civil contracts.  If the contract says no commercial purposes, well gifting seeds is not a commercial purpose.  But the result is that the seed is set free.

Not sure if I like the idea.  The fight the man in me wants to cheer.  But not sure who the man is anymore.  Could be you are fighting the common man, not so much cheering there.
 
I think I was on a homesteading site when I read about contract busting.  Lots of those folk seed swap and participate in seed libraries.  At swaps there are some sales but its like a dollar here and there.  They ted to think of Monsanto as Satan and dont want contracts attached to anything.  It the whole live free thing fear da man.
