Not sure about birds but I've got a plastic bobble head owl and a hawk and both keep the rabbits away. Have never seen any birds in my grow but not sure if that's because of the owl/hawk or if birds just don't mess with it. The huge oak in my yard along with the power lines are full of crows this time of year. All day long with their racket drives me nuts. Not one bird in the peppers or tomatoes though. But again maybe they're just not interested. Just make sure you move the location of the owl every few days

Yeah terribly short growing season here in Washington and my plants didn't produce so starting another month and a half early this year and may break down and get greenhouse

I'd suggest birds.  This is a relatively young pod, yet it should still have some self-protective heat.

Birds, though, aren't sensitive to capsaicin.

I would say birds
We have Crows / Ravens all over
Never saw them eat any of my peppers.
But the Cardinals and Sparrow type go to town. And yeah as suggested... Capsaicin does nothing to them. They just love my Tabasco plants in past. Especially when ripe.
